These General Terms and Conditions of Sale (GTCS) define the terms and conditions of sale between Arvea Retails and the Customer. They are intended to inform the customer about ordering, delivery and payment procedures, as well as the returns policy for all orders placed on the www.arveanature.com website.

Please read these Terms and Conditions, our Cookie Policy and our Privacy Policy (hereinafter referred to as the "Data Protection Policies" carefully before using this website. By accessing this website or placing an order on it, you agree to be bound by these Terms and our Data Protection Policies. If you do not agree to all of these Terms and Data Protection Policies, please do not use this website.

Placing an order on the Site implies the customer's acceptance of the general terms and conditions of sale to the exclusion of any other terms and conditions contained in prospectuses or catalogs or other communication media issued by Arvea Retails.

These conditions apply exclusively to non-trading individuals. Products purchased on this site are not intended for resale.

Arvea Retails reserves the right to refuse any customer order deemed dubious and not for personal use.

In this case, Arvea Retails will refund the amount paid by the customer within 10 working days.

The website www.arvea-nature.com is an online sales platform specializing in the retail sale of cosmetics to end consumers.

The sale of items through this website is carried out by the company Arvea Retails, S.A.R.L. under Tunisian law with a capital of 2.707,000, whose registered office is located at: 48 Rue des Minéraux, 2035 – Tunis, M.F: 1492625/W/M/N 000, registered with the RNE under number 1492625W..

A pioneer in direct sales, Arvea Retails offers you a wide range of products: perfumes, make-up, skincare, food supplements and accessories.

Arvea Retails reserves the right to modify these General Terms and Conditions of Sale at any time. Nevertheless, the General Terms and Conditions of Sale applicable to the Order are those accepted by the customer at the time the Order is placed.

GENERAL PROVISIONS FOR ALL SALES

Controls

1- Products are sold while stocks last.
2- Arvea Retails retains ownership of the Products delivered until invoices have been paid in full and reserves the right to suspend delivery in the event of late payment, until the account has been settled in full.

Arvea Retails reserves the right to refuse an order or to request advance payment in the event of late payment or insolvency.

Rates and payment terms

The selling prices of the products online on the Arvea Retails website, indicated in Tunisian dinars and inclusive of all taxes, are those in force at the time the order is placed by the customer.

Arvea Retails reserves the right to modify product prices at any time, but price modifications will not apply to orders already confirmed.

The prices indicated on the site include the value-added tax (VAT) applicable on the day of the order. Any change in the applicable rate will be systematically reflected in the price of products sold on the site.

Prices apply to distance selling. These prices do not include shipping costs, which are invoiced in addition to the price of the products purchased.

Shipping costs will be indicated before the customer registers the order. The various shipping methods are set out below in the general terms and conditions of sale and are indicated on the website; they may be modified at any time by Arvea Retails.

Purchase invoices will be sent with the parcel, subject to a 1 dinar tax stamp charge. Arvea Retails offers two payment methods:

Payment on delivery The customer may also pay for the items ordered in cash on delivery. In this case, the customer should, as far as possible, prepare the exact amount of the order, as delivery personnel do not always have change.

Payment by credit card The following credit cards are accepted on the Arvea Retails website: Visa and Mastercard. The customer can pay online on our website using these credit cards. By clicking on "pay", you confirm that the card belongs to you.

To ensure the security of payment by credit card, the customer must provide Arvea Retails with the visual cryptogram (CVV) on the back of the credit card used by the customer.

Credit cards are subject to validity checks and authorization by the card issuer. If Arvea Retails does not receive the required payment authorization, Arvea Retails will not be held responsible for any delay or failure to deliver the products and will not be able to enter into a contract with the customer.

In accordance with our commitment to payment security, all details communicated at the time of the customer's order are never transmitted unencrypted over the network. Under no circumstances is the customer's credit card number stored by Arvea Retails.

However, as part of the fight against Internet fraud, information relating to the customer's order may be transmitted to any third party authorized by law or designated by Arvea Retails for the sole purpose of verifying the customer's identity, the method of payment used and the intended delivery. Following this check, Arvea Retails reserves the right to request any information relating to the customer's identity. All customers have the right to access, rectify and delete their personal data.

Order preparation, shipping and delivery Arvea Retails delivers only within Tunisia.

Products ordered by the customer in accordance with these General Terms and Conditions of Sale (GTCS) will be delivered to the address indicated by the customer as the delivery address on the order concerned ("Delivery Address").

Our usual lead times are 1 to 2 working days. Delivery times begin as soon as the order confirmation e-mail is sent. Orders are delivered within 2 to 3 working days within Tunisia.

A). Delivery charges : 7 dinars delivery charge.

Please note that home deliveries cannot be made on Sundays and public holidays.

The customer or the recipient of the order is delivered by the company ARAMEX. The customer will receive a call from the aramex courier, informing him/her of his/her arrival at the address indicated. In the event of absence, the customer or the recipient of the ordered product will be contacted by the aramex courier within 3 days. After 3 delivery attempts, and if the customer is still unavailable, the parcel will be returned and the order cancelled. If payment has already been made online, Arvea Retails will reimburse the amount paid, minus any shipping costs, within 10 working days.

Arvea Retails invites you to check (or have checked by the agent receiving the order) the apparent condition of the package. Regardless of the carrier, in the presence of an apparent anomaly, the customer must refuse the parcel.

For the purposes of these conditions, "delivery" shall be deemed to have taken place or the order to have been "delivered" as soon as the customer or a third party indicated by the customer acquires physical possession of the goods, which shall be evidenced by the signature of the order receipt at the delivery address.

B). Orders Not Received The customer may contact Arvea Retails by e-mail at the following address : [email protected] in the event of late or non-delivery of his order. The customer may cancel the order if delivery has not taken place within 7 working days of the delivery date indicated by Arvea Retails, unless the delay in delivery is due to force majeure. Arvea Retails undertakes to reimburse the full amount paid within 10 working days of notification by the customer of the cancellation of his order.

C). Product returns and refunds In the event that the product delivered does not correspond to that ordered by the customer, Arvea Retails will take care of the return and replacement of the product on presentation of the sales invoice and provided that the product is sealed and in its original packaging . The return is handled by Aramex's delivery service. In this case, no return costs will be charged to the customer.

After this period , no refund can be claimed. Arvea Retails will take care of the return and replacement of the customer's order at no extra charge.

If the customer wishes to cancel the order, Arvea Retails will refund the full amount paid within 10 working days.

As a consumer, the customer has the right, in accordance with current regulations, to withdraw from the contract without giving any reason. The deadline for exercising the right of withdrawal is 10 working days from receipt of the order. Once this period has elapsed, the customer will no longer be entitled to exercise this right. Notification of withdrawal must be sent by e-mail to the following address [email protected]

If the customer decides to withdraw from the contract, he/she must contact Arvea Retails by email at and return the order without delay. To do this, the customer can drop it off at one of our Arvea Retails stores, along with the purchase invoice (see the list of our stores in the "My store" section). Please note that products ordered must be returned in perfect condition and in their original packaging. In addition, items must not have been used.

After examining the returned products, Arvea Retails will inform the customer if he/she is entitled to a refund given the condition of the products. If Arvea Retails considers that the items are in a satisfactory condition, Arvea Retails will then proceed to reimburse the customer's order within 10 days from the date of the actual return of the items. The refund will be made by bank transfer to the customer's personal account. Please note that Arvea Retails reserves the right to withhold reimbursement until the products in question have been received.

Withdrawal may not be exercised in the following cases:

The order includes personalized items.
The order contains items which are not in perfect condition and in their original packaging or which are damaged.

Complaints: In the event that the product delivered has been damaged during transport, the customer must report this immediately to the deliverer and has a period of 24 working hours from the date of receipt of the order to make a complaint. Intellectual property

The documents and elements (text, images, video, audio) contained on the Arvea Retails website as well as their layout are the exclusive property of Arvea Retails and/or its suppliers.

Arvea Retails does not grant any license or right other than that of consulting the site.

Reproduction of any documents published on the site is authorized exclusively for personal and private use. Any other use is strictly forbidden. 

Arvea Retails reserves the right to claim damages in the event of infringement of its intellectual property rights.

Personal data
Arvea Retails is committed to preserving the confidentiality of information provided online by the customer to Arvea Retails for the proper management of orders, deliveries, invoices and the use of certain services.

Customers have the right to access, modify, rectify and delete data concerning them.

Arvea Retails may use cookies placed on the computers of visitors to its website. A cookie file records information about the browsing habits of visitors to the Arvea Retails website. Thanks to cookies, visitors no longer need to fill in certain previously requested information on their next visit.

Arvea Retails informs the customer that this personal data will be collected and used by its internal services and/or those of the companies of the group to which Arvea Retails belongs:

To inform customers of upcoming sales and events, by sending invitations by e-mail, SMS, newsletters, etc.

To process the customer's order,

To reinforce and personalize communication, in particular by sending newsletters, special offers (in particular competitions, games, etc.) and special emails as part of the personalization of the website according to customer's preferences.

Consequently, the customer expressly authorizes Arvea Retails to process his/her personal data in accordance with the provisions of Organic Law No. 2004-63 of 27/04/2004 on the protection of personal data.

Arvea Retails informs the customer that it may also store the customer's personal information for as long as is necessary to provide the best possible service.

Force majeure
Arvea Retails shall not be held liable for non-performance of the contract entered into, due to the occurrence of an event of force majeure or fortuitous event, including, but not limited to, catastrophes, fires, internal or external strikes, internal or external failures or breakdowns, and in general any event preventing the proper execution of orders.

Specific provisions applicable to distance selling

Scope of application These provisions apply to the sale of products by telephone, internet or, more generally, any other means of distance communication. In order to improve the quality of our customer relations and the reliability of orders, telephone conversations may be recorded.

Disputes
Any dispute relating to the conclusion, interpretation, performance or breach of contract between and the customer shall, in the absence of amicable agreement, be subject to the jurisdiction of the Tunis courts. Relations between the company and the customer are subject to Tunisian law.

No waiver
The fact that Arvea Retails refrains from demanding the execution of any of the provisions of the GTC shall not be interpreted as a waiver of the right to invoke the said total or partial non- execution at a later date.

Validity of terms and conditions

If any provision of these GTC is declared invalid in whole or in part, the other provisions and the other rights and obligations arising from these GTC shall remain unaffected and shall continue to apply.
